Terms of Service

Introduction
Welcome to Cutform. These Terms and Conditions ("Terms") govern your access to and use of the Cutform website and AI-powered podcast editing services (the "Service") operated by Cutform ("we," "us," or "our").
By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service. You must be at least 16 years old to use Cutform.
Account Registration
To access certain features of the Service, you must create an account. You agree to:
- Provide accurate and complete information during registration
- Keep your account credentials secure and confidential
- Notify us immediately of any unauthorized access to your account
- Accept responsibility for all activity that occurs under your account
We reserve the right to suspend or terminate accounts that violate these Terms or contain inaccurate information.
The Service
Cutform provides AI-powered tools that analyze podcast audio and video content to identify high-retention moments and generate optimized clips for social media distribution.
Early Access. Cutform is currently in an early access program available to a limited number of creators. Features, capabilities, and availability may change as we develop the platform. Early access does not guarantee continued free access or specific feature availability.
We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice.
Your Content
Ownership. You retain full ownership of all podcast audio, video, and other content you upload to Cutform ("Your Content"). We do not claim ownership of Your Content.
License grant. By uploading content, you grant Cutform a limited, non-exclusive, royalty-free license to process, analyze, and transform Your Content solely for the purpose of providing the Service to you. This license terminates when you delete Your Content or close your account.
Content guidelines. You represent and warrant that:
- You own or have the necessary rights to upload and process Your Content
- Your Content does not infringe the intellectual property or privacy rights of any third party
- Your Content does not violate any applicable law or regulation
Intellectual Property
Cutform's IP. The Service, including its design, features, code, algorithms, branding, and documentation, is owned by Cutform and protected by intellectual property laws. Nothing in these Terms grants you rights to use our trademarks, logos, or branding.
Output ownership. Clips and edited content generated by our AI tools from Your Content belong to you. You are free to use, distribute, and monetize the output as you see fit.
Acceptable Use
You agree not to use the Service to:
- Upload content you do not have the rights to use or distribute
- Process content that is illegal, defamatory, or violates the rights of others
- Attempt to reverse-engineer, decompile, or extract the source code of our AI models or software
- Interfere with the Service's operation, security, or other users' access
- Use automated tools (bots, scrapers) to access the Service without our written permission
- Resell, sublicense, or redistribute the Service to third parties
Violation of these restrictions may result in immediate account termination.
Early Access & Pricing
Cutform is currently offered at no cost during our early access period for the first 50 creators. We reserve the right to:
- Introduce paid plans or change pricing at any time with reasonable notice
- Modify the features or limitations of the free tier
- Limit the number of users in the early access program
Early access participation does not guarantee continued free access to the Service. We will provide notice before any pricing changes take effect.
Availability & Modifications
We strive to keep the Service available and reliable, but we do not guarantee uninterrupted or error-free access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.
We reserve the right to modify, update, or discontinue the Service (or any part of it) at any time. We will make reasonable efforts to notify you of significant changes.
Limitation of Liability
Disclaimer of warranties. The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Limitation. To the maximum extent permitted by law, Cutform shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or content, arising from your use of or inability to use the Service.
Our total liability for any claim arising from or related to these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $100 USD, whichever is greater.
Indemnification
You agree to indemnify, defend, and hold harmless Cutform and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from:
- Your use of the Service
- Your Content or your violation of any third party's rights
- Your violation of these Terms or any applicable law
Termination
We may suspend or terminate your access to the Service at any time if you violate these Terms or if we discontinue the Service. You may also close your account at any time by contacting us.
Upon termination, your right to use the Service ceases immediately. We will retain Your Content for a reasonable period to allow you to retrieve it, after which it will be deleted. Provisions that by their nature should survive termination (including limitation of liability, indemnification, and governing law) will remain in effect.
Governing Law
These Terms are governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved through binding arbitration or in the courts of competent jurisdiction.
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect.
GDPR Addendum
For users in the European Economic Area (EEA) or United Kingdom, the following additional terms apply:
- We process your personal data based on your consent (account creation) and our legitimate interest in providing and improving the Service.
- You have the right to withdraw consent at any time by deleting your account.
- We act as a data controller for account and usage data, and as a data processor for Your Content.

Changes to Terms
We may revise these Terms from time to time. When we make material changes, we will notify you by posting the updated Terms on this page with a revised "Effective" date. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
